Terms and Conditions - Midas Marketing

These Terms of Service and the conditions listed below apply to Midas Marketing LLC, www.winwithmidas.com, and all products/services offered by Midas Marketing, and the conditions concerning your use of and access to the Midas Marketing website. By accessing, using, or downloading any materials or content from the website, you agree to follow and will be bound by all conditions included in this document. If you do not agree with these Terms you may not use our products, hire us for services, and/or use our website.

Use Provisions

Internet Services, Content, Products, and Accuracy of Data: We attempt to ensure that information on this website is complete, accurate, and current, however, due to the nature of the information we gather (and its sources) it may be inaccurate, incomplete, or out of date. We make no guarantees as to the accuracy or completeness of any information expressed on our website. All features, content, product descriptions, product pricing, services, and statements of said products and services described or displayed on this website are subject to change at any time without notice. Midas Marketing continually attempts to accurately display all aspects of our products and services.

Order Confirmations

It is our practice to confirm orders by email receipt. Receiving said email binds the client to their obligations as outlined in the Billing and Payments Section included in this agreement. Receiving an email receipt does NOT constitute an agreement beyond the specified details of that receipt. Anyone who completes a payment using our client-side confirms that they have received a receipt and will be bound by the terms and conditions regarding Billing and Payments below. We reserve the right without prior notice and at our discretion to refuse service to any customer along with access to the website by any visitor or customer should it be used inappropriately or beyond the scope of what Logical Position deems acceptable.

Materials & Content

ALL materials and content provided by Midas Marketing or displayed on www.winwithmidas.com require written authorization to be used or transmitted by any user of the website. Any material generated by Midas Marketing and displayed on the website is the sole property of Midas Marketing. This includes, but is not limited to: Product Branding, Report Generation, Images, Client Data, Content, and Accounts Created.

Any unauthorized use of said materials and content may violate local, state, or federal laws designed to protect copyrights, trademarks, and intellectual capital. It is the client’s responsibility to comply with the laws governing their use of the website and protect their personal information (specifically account username/password) along with the confidentiality of their information that may be displayed. You agree to accept responsibility for all activities that occur within your account and will NOT hold Midas Marketing liable should the account (or its data) be compromised by an unauthorized user.

Billing & Payments

Midas Marketing has specific policies concerning billing and payments. ALL products and services offered by Midas Marketing fall under this scope, including but not limited to: Lead Generation PPC, Ecommerce PPC, SEO (and all addons), Websites (and all addons), Brand Development (and all addons). Payments may be made by credit card or check (in some instances). Any money that has been spent on an account by Midas Marketing to any third party (specifically search engines) is not refundable at any point. Set-up fees charged for account creation and establishment are not refundable.

ALL accounts are put on a recurring payment cycle unless specified otherwise by the customer at the point of sale. Any client wishing to be taken off recurring status, pause an account, or cancel an account must contact Midas Marketing at 888-629-8257 at least 30 days prior to the due date of their next payment. It is the sole responsibility of the customer to contact Midas Marketing to cancel their account.

Payments made by credit card MUST be successfully processed by Midas Marketing to keep accounts online and active to prevent any ‘down-time’ or temporary termination of service.

One-Time Payments – Projects

You authorize Midas Marketing to charge your checking account or credit/debit card one time in order to pay for products or services.

Payment must be made in full for the project or current phase of the project in order for work by Midas to start.

Recurring Payments (Subscriptions)

You authorize regularly scheduled debits to your checking account or credit/debit card. Your account/card will be debited/charged the amount indicated on your billing statement.

You may request a payment date for renewals anytime between the 1st and 15th of every month. Subscriptions that start after the 15th of the month will automatically be set to renew on the 15th starting on month 2.

Note: You must provide notification at least 30 days prior to your due date of any changes to your ACH account information.

Cancellation: We don’t do long-term commitments or contracts, but we do require notice of cancellation 30 days before your subscription’s renewal date.

ACH Debit

I understand and agree that any and all changes in my account information, including requests to terminate this agreement, must be in writing and be delivered to Midas Marketing at least 30 days prior to the next due date. If the payment due date falls on a weekend or holiday, I understand and agree that the payment may be executed on the next business day. I understand and agree that as this is an electronic transaction, adequate funds must be available for withdrawal from my account by the payment due date. In the case of an ACH transaction being rejected for Non-Sufficient Funds (NSF), submission error, or other bank-related return reasons I understand and agree that Midas Marketing may at its discretion resubmit the ACH debit transaction at any point within thirty (30) days. I understand and agree that a return item charge ($30) may be assessed for each returned ACH debit.

I acknowledge that the origination of ACH transactions to my account must comply with provisions of U.S. law and agree not to dispute this recurring billing with my bank so long as the transactions correspond to the terms indicated in this authorization form.

Credit & Debit Cards

You authorize Midas Marketing to charge your credit or debit card for agreed upon purchases. You understand that your billing and card information will be saved securely to file for future transactions on your account.

Termination

Midas Marketing has the right to terminate your account at any time for any reason and you “the user” or “account holder” has the right to terminate your account at any time for any reason within the guidelines of our Billing and Payments Section.

Refunds

Midas Marketing provides you with world-class brands, websites, and marketing campaigns with no long-term commitments or contracts. Because of this, we only offer refunds in the following situations:

Monthly Customers: Eligible for a refund within 72 hours of purchasing or renewing a monthly plan.
Annual Customers: Eligible for a refund for 30 days after purchasing or renewing a yearly plan.
Projects: If deliverables are not met due to Midas’ lack of execution. No refunds will be given due to client backing out of the project unless a breach in contract exists.

Outside of these windows, you can cancel your subscription at any time. Your subscription will remain active until the next billing cycle, at which point it simply will not be renewed. Your backups and content will be available through the end of the subscription. The use of a discount code or offer may affect the amount of your refund.

Chargebacks

Any unauthorized chargebacks are subject to a $500.00 fee, at the discretion of Midas Marketing.

Liability

Midas Marketing accepts no responsibility in the following instances: should an account be brought off-line as a result of technical difficulties at our facilities or those of the vendors Midas Marketing uses. Due to the technical nature of our products and services, Midas Marketing can not be held responsible for technical difficulties that occur. Midas Marketing’s services are designed to be employed and managed by Midas Marketing and do not guarantee any increase in business or specific traffic levels to a given advertisement. Any loss of business resulting from an advertisement, website, or other product or service Midas Marketing provides or aids in the creation of is solely the responsibility of the client. If a client notices an error in their account, on their advertisement, or in any product or service, it is solely their responsibility to contact Midas Marketing to have it changed.

Third-Party Disclosure

Midas Marketing uses third parties for various products and services and cannot be held responsible for downtime or loss of business due to the failure of said third parties.

Representations and Warranties

Each party represents and warrants that it has the power and authority to enter into this agreement and fully understands ALL of the TERMS AND CONDITIONS expressed within.

Intellectual Property Notice

All elements of this website (www.winwithmidas.com) that have been generated by Midas Marketing are the intellectual property of Midas Marketing.
